Acceptable Use Policy

General Prohibited Activities

You will not use the Services to, and will not permit any Authorized User or third party to:

• violate any applicable local, state, national, or international law or regulation;

• infringe, misappropriate, or otherwise violate any patent, trademark, copyright, trade secret, right of publicity or privacy, or other intellectual property or proprietary right of any third party;

• transmit, store, or distribute any viruses, malware, ransomware, or other harmful or malicious code, or otherwise interfere with or disrupt the integrity, security, or performance of the Services or any data or systems connected to the Services;

• attempt to gain unauthorized access to the Services, other customers’ accounts or data, or any related networks or systems, or probe, scan, or test the vulnerability of the Services;

• scrape, crawl, or harvest data from the Services or from any website or platform accessed through the Services, except through features we expressly provide for that purpose;

• reverse engineer, decompile, or otherwise attempt to derive the source code of the Services, except as expressly permitted by applicable law;

• circumvent, disable, or otherwise interfere with any billing mechanism, usage limit, security feature, or access control of the Services;

• resell, sublicense, or provide access to the Services to any third party otherwise than as expressly permitted under the Agreement; or

• use the Services in any manner that could damage, disable, overburden, or impair the Services or interfere with any other party’s use of the Services.

Prohibited Content

You will not use the Services to submit, upload, collect, request, transmit, or store any content, review, message, or data (including through Lightning Reviews, Lightning Connector, or Lightning Returns) that:

• Promotes hate or discrimination. Encourages, promotes, or facilitates hate, violence, or discrimination against individuals or groups based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, age, or any other protected characteristic;

• Facilitates illegal activity. Promotes, facilitates, or provides instructions for fraud, identity theft, unauthorized data access, the sale or distribution of illegal or controlled substances, weapons, or counterfeit goods, or the exploitation or endangerment of minors;

• Is misleading or deceptive. Impersonates any person or entity, misrepresents your affiliation with a person or entity, or contains false, deceptive, or materially misleading claims, including fake or incentivized reviews, review gating, or reviews that misrepresent a product, service, or reviewer’s actual experience;

• Is obscene or sexually explicit. Contains pornographic, obscene, or otherwise sexually explicit material that is unlawful or inappropriate for a general commercial audience;

• Is fraudulent. Advertises counterfeit goods, deceptive pricing or discount claims, pyramid or Ponzi schemes, or other scam offers; or

• Targets or exploits children. Is directed at, or knowingly collects personal information from, children under the age of 13 (or 16 in the European Economic Area) without the consent required by applicable law.

Prohibited Data

The Services are not designed or intended to collect, process, or store, and you will not submit through the Services, any:

• government-issued identification numbers (such as Social Security numbers, passport numbers, or driver’s license numbers);

• financial account, payment card, or bank account numbers, except as expressly permitted through a payment feature we designate for that purpose;

• health, medical, or biometric information, including information protected under HIPAA or similar laws;

• “special category” personal data as defined under GDPR or similarly sensitive personal data under other applicable privacy laws (such as data revealing racial or ethnic origin, religious beliefs, political opinions, trade union membership, sexual orientation, or genetic or biometric data), unless you have a lawful basis to process such data and have configured the Services accordingly; or

• personal information of children under 13 (or 16 in the EEA), except as expressly permitted by applicable law and any features we provide for that purpose.

Customer Communications (Review Requests and Notifications)

If you use Lightning Reviews or other features of the Services to send review requests, order or returns notifications, or other messages to your customers by email, SMS, or other channels, you will:

• only send messages to individuals who have provided the consent required by applicable law (including CAN-SPAM, TCPA, CASL, and similar laws) and your own privacy policy;

• not send messages to purchased, rented, harvested, or third-party contact lists, or to individuals who have opted out or unsubscribed;

• accurately identify yourself as the sender and not falsify or obscure header, routing, or sender information, and not use techniques intended to evade spam or content filters;

• honor unsubscribe and opt-out requests promptly and provide a working mechanism for recipients to opt out; and

• comply with all other applicable laws and industry guidelines (such as CTIA guidelines for SMS) governing the content and delivery of your messages.

Restricted Businesses and Use Cases

Without our prior written consent, you may not use the Services in connection with, or to sell, promote, or facilitate:

• illegal drugs, controlled substances, or drug paraphernalia (including CBD, cannabis/marijuana, and vaping or e-cigarette products where prohibited);

• firearms, ammunition, or explosives;

• counterfeit or unauthorized replica goods;

• gambling, sports betting, or games of chance;

• escort services, adult content, or sexually oriented businesses;

• multi-level marketing, pyramid schemes, or “get-rich-quick” or work-from-home offers;

• payday loans, debt relief/consolidation services, or other high-risk financial products or services;

• cryptocurrency, digital asset, or similar speculative financial offerings;

• data brokering, list rental, or the sale of consumers’ personal information; or

• prescription medications or telehealth services, except by entities properly licensed to do so and in compliance with applicable law.

We may, in our discretion, permit a use case described above on a case-by-case basis; contact us at legal@lightningcommerce.ai if you believe your use case should be considered.

Enforcement

We may, without liability to you, investigate, monitor, suspend, limit, or terminate your access to the Services at any time, without notice, if we determine in our reasonable discretion that you have violated this Policy or the Agreement. We reserve the right, but have no obligation, to review, monitor, or remove content submitted through the Services, and to report suspected illegal activity to law enforcement or other appropriate authorities and to cooperate with their investigations.

Updates to This Policy

We may update this Policy from time to time to reflect changes in our Services, legal requirements, or industry practices. The “Last Updated” date at the top of this Policy indicates when it was last revised. Material changes will be communicated as described in the Agreement. Your continued use of the Services after an updated Policy takes effect constitutes your acceptance of the changes.
